Protection Program Consumer Terms

Your use of www.bestdfwcontractors.com constitutes your agreement to all such Terms. This website is owned by Best DFW Contractors, LLC. Please read these terms carefully, and keep a copy of them for your reference.

Under the Protection Program, you can use the Best DFW Contractors website to get quotes from and hire qualified Best DFW Contractors service professionals in supported categories to complete tasks within a scope and budget that you and the Best DFW Contractors contractor have agreed upon (your "Project"). If you're not reasonably satisfied, we will pay up to $20,000 to fix or complete your project, subject to these Best DFW Contractors Consumer Terms ("Guaranteed Terms").

PLEASE READ THE SECTION “CHOICE OF LAW, ARBITRATION, FORUM SELECTION, AND CLASS ACTION WAIVER”  CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

By taking part in our Protection Program, you attest that you are at least twenty five old, that you have read these Guaranteed Terms, and that you agree to be bound by them. Please be aware that the contractor you hire may ask you to agree to additional terms, and that these Guaranteed Terms will take precedence over any other terms in any dispute pertaining to matters involving Best DFW Contractors and you.

Please notice that if the homeowner or contractor takes legal action against each other, we will not be able to assist, compensate or get involved in the situation and our resolution process will be null.

Before hiring any of the contractors listed on our website, you must register the project through our website and have it approved by our team via email. This will automatically entitle you to coverage under the Protection Program for the Project carried out by that contractor, subject to the eligibility requirements and limitations listed below.

- Best DFW Contractors does not guarantee that the service will live up to your expectations, even if it might compensate you for issues relating to services from one of our contractors. It's crucial to assess the Best DFW Contractors on your own, exercise common sense, and carry out independent research.

- If you're not reasonably satisfied with the quality of work one of our contractors completed for a project you arranged through the Site, Best DFW Contractors may, at its sole and absolute discretion, pay another contractor of our network to resolve the issue reasonably up to the lesser of (a) your documented payments made to the contractor for the Project, or (b) $20,000; subject to the restrictions and conditions in these Guaranteed Terms. If we do not have a contractor available, we will pay a contractor of your preference to fix or complete your project up to $20,000. (BDFW must approve your preferred contractor and their quote). The following kinds of issues are normally covered by the Protection Program, though coverage will vary based on the particular facts and circumstances:

1- your discontent with the task itself (for example, the plumber did not fix your faucet) but not the encounter (for example, the plumber was unkind or late);

2- harm to your property that the contractor repaired as part of the project if their insurance declines paying for such damages. (for example, a hole in your ceiling being caused by a roofer);

3- deposit theft (for example, the contractor was paid a deposit and ghosted you)

Things Best DFW Contractors Doesn't cover. Best DFW Contractors will not reimburse you for any losses or damages resulting from the following, as decided solely at Best DFW Contractors' discretion; this is not covered by the Protection Program.

1- discontent with the experience (e.g., the plumber was impolite);

2- job completed beyond the project's parameters (for example, if you ask the contractor to complete extra tasks not initially planned for the project);

3- activities or occurrences that are unrelated to the project, outside its purview, or not reasonably foreseeable considering the project's nature (for example, a painter sitting on your Faberge egg or a plumber stealing your pocketbook)

4- Pricing conflicts without documented evidence of a legally binding quote that both parties have agreed upon (for example, a plumber estimating the cost of a water heater without a legally binding final quote might charge $2,000 because she missed extra plumbing). In order to help you with any future cost issues and to help Best DFW Contractors evaluate your claim, we strongly advise you to get a binding quote in writing from the contractor as soon as you can.

5- Code & Manufacturer Non-Compliance related issues.

Limitations. Coverage under the Protection Program is further limited, at Best DFW Contractors' sole discretion, as follows:

1- The maximum coverage per project is $20,000

2- Any loss or harm that Best DFW Contractors logically feels was unforeseeable at the time the Project was agreed upon is not its responsibility, and Best DFW Contractors will not pay for it.

Eligibility. To be eligible for coverage under the Protection Program, you must:

1- Register the project at www.bestdfwcontractors.com and have it approved by the admin team via email.

2- Be 25 years old or older.

3- not otherwise be prohibited from participating in the Protection Program.

4- not have a commercial, familial, or other relationship with any of our contractors you engage, nor be a current employee or contractor of Best DFW Contractors;  

5- Project must be registered and have started after November 1st, 2024.

Making a claim -  If you are not reasonably satisfied with the work performed by a contractor that was hired through the Protection Program on the Site:

1- You should first attempt to resolve your concerns with the the contractor.

2- If you are unable to resolve your concerns with the contractor, please submit a claim request form electronicallyin its entirety. You represent and warrant that the information you provide is complete and accurate.

3- You must make your request and submit all supporting documentation and the information required to process your request within thirty (30) days after the date of your last payment to the contractor for the Project.

4- Your claim must include, among other information that may be requested by Best DFW Contractors to help us better evaluation the claim: (a) proof of payment to the contractor, (b) documentation supporting the scope of the Project, the price agreed upon, and the work performed, such as a receipt that clearly shows the amount paid and the contractor’s business name that matches the name on Best DFW Contractors and additional evidence of service upon request, and (c) evidence of any loss or damage, and documentation supporting the replacement cost or cost to fix, subject to independent verification by Best DFW Contractors.

Best DFW Contractors may collect similar information from the contractor about your Project and refund request, and, at its sole discretion, make a determination about whether you are entitled to a refund under the Protection Program.

Before the contractor starts working, you should insist on receiving a legally binding quote in writing. If you don't, it can be more difficult for you to get relief through the Protection Program.

Your Information. Best DFW Contractors may access and use your information, including information that you have provided to a contractor through the Site in connection with the Protection Program.

The data that Best DFW Contractors gathers and/or makes available about every contractor—such as whether or not it is part of the Protection Program, whether or not it is licensed, and whether or not it has ratings and reviews— is merely provided to help you assess the contractor. To find out if a contractor is right for you, you need do your own research. Since Best DFW Contractors is unable to verify if a particular contractor will meet your needs, please exercise your best judgment when choosing and interacting with contractors. We only provide details about the contractor—such as whether or not they have undergone screening—to aid in your assessment.

Service Quality and Disclaimer. You agree that contractors are responsible for the services they provide and any associated claim, not Best DFW Contractors. Further, You agree that Best DFW Contractors is not liable to you for any damage, loss, or other liabilities you may incur in connection with a contractor or its services. The Protection Program does not provide a product warranty or endorsement of contractors services, nor is it a form of insurance. All decisions related to your eligibility and ability to collect payments or receive assistance related to the Protection Program are made at Best DFW Contractors’ sole discretion.

deception. By utilizing the Protection Program to book a service, you agree to indemnify, defend, and hold harmless Best DFW Contractors from any claims, losses, or liabilities arising from or related to your violation of these Guaranteed Terms. You also understand and acknowledge that it is illegal to attempt to collect or obtain a cash refund for a payment card purchase or to initiate a fraudulent chargeback while pursuing or intending to pursue a claim through Best DFW Contractors or from the contractor. If Best DFW Contractors finds proof that you intentionally submitted false claims or engaged in other fraudulent activity pertaining to the Protection Program, Best DFW Contractors retains the right to take legal action and pursue other remedies. Best DFW Contractors maintains the authority to prohibit you from taking part in the Protection Program if Best DFW Contractors believes you have participated in any fraudulent activity, including deleting your Best DFW Contractors account.

Interactions. When you give Best DFW Contractors a mobile number or any other phone number as part of the Protection Program, you (a) affirm and guarantee that you are the subscriber of record for that number or that you have the proper authorization from the subscriber of record to use that number and allow others to contact you, and (b) specifically consent to Best DFW Contractors and its representatives calling that number and sending text messages (such as SMS or MMS messages).

Changes to the Guaranteed Terms. Best DFW Contractors has the right to amend, add to, or remove any portion of the Guaranteed Terms. It is your obligation to read this terms at the time of hiring a contractor.

Class Action Waiver. YOU AND BEST DFW CONTRACTORS AGREE THAT EACH MAY BRING OR PARTICIPATE IN CLAIMS AGAINST THE OTHER ONLY IN THEIR RESPECTIVE INDIVIDUAL CAPACITIES, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND BEST DFW CONTRACTORS AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. IF A CLAIM IMPLICATES THAT THIS SUBSECTION, AND THIS SUBSECTION IS FOUND TO BE INVALID, UNENFORCEABLE OR ILLEGAL BY A COURT, SUCH CLAIM MUST BE ADJUDICATED BY A COURT AND NOT BY AN ARBITRATOR.

Each of the parties hereto irrevocably waives any and all right to trial by jury in any legal proceeding arising out of or relating to this agreement or the transactions contemplated hereby.

Privacy

Your use of BestDFWcontractors.com is subject to Best Contractors DFW's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications

Visiting BestDFWcontractors.com or sending emails to Best DFW Contractors constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Best Contractors DFW is not responsible for third party access to your account that results from theft or misappropriation of your account. Best Contractors DFW and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Welcome to BestDFWcontractors.com. The www.bestdfwcontractors.com website (the “Site”) is comprised of various web pages operated by Best Contractors in DFW. BestDFWcontractors.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of BestDFWcontractors.com.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

Please understand that it is our intention to protect both the homeowner and the contractor. Our processes cannot be completed unless followed correctly. We do not try to make it difficult, but we need to clearly state this up front. The BDFWC Workmanship Guarantee and our involvement in the resolution process will become null and void if the homeowner takes actions into their own hands and complicates the resolution process, to include the following:

-Writing bad reviews or any online retaliation before allowing Best Contractors in DFW to work through the resolution process. However, we will give you the opportunity to remove the bad review and begin the resolution process once the negative review has been removed. Please note that it is your right to write a bad review, we just want the opportunity to fix your problem first. We want to give the contractor the opportunity to do the right thing and hopefully avoid hurting their business with a negative review.

-Initiating any legal actions toward the contractor before allowing Best Contractors in DFW to work through the resolution process. If legal action or attorneys become involved, we cannot get involved in a resolution. Our liability is strictly dependent on being allowed the opportunity to work through our resolution process without interference.

-Not allowing the original contractor the opportunity to resolve the issue with Best Contractors in DFW being involved. The contractor must be given the opportunity to redeem themselves with our help. The resolution process becomes very difficult to manage when attacks are made and homeowners try to take things into their own hands. If any of the above actions are taken BEFORE allowing Best Contractors in DFW the opportunity to work through the ENTIRE resolution process, the Guarantee and further involvement in the resolution will be null and void.

1. Acceptance of Terms
PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING, DOWNLOADING, OR USING ANY OF BEST CONTRACTORS IN DFW SITES AND SERVICES, YOU AGREE TO BECOME BOUND BY THESE TERMS OF GUARANTEE. IF YOU DO NOT AGREE TO ALL THE TERMS OF GUARANTEE, THEN YOU MAY NOT ACCESS AND USE THE SITES AND SERVICES.

2. Modification of Terms of Use
Best Contractors in DFW may, in its sole discretion, modify these Terms of Use at any time effective upon the posting of the modified Terms of Guarantee on and in connection with the Sites and Services, with or without any additional notice to you. You are responsible for regularly reviewing information posited on the Site and Service to obtain timely notice of such changes, and if you do not agree to the amended terms, you agree to immediately stop using the Sites and Services and to provide Best Contractors in DFW notice to remove you from any distribution or other communication list that are available to you through the Sites and Services.

3. Terms of the Guarantee
If you are not satisfied with the work performed by your contractor, Best Contractors in DFW will attempt to make it right by bringing in the same or another contractor to repair or replace the problem. We will expend up to the security deposit provided by the contractor in order to fix the problem. You will be responsible for any charges in excess to fix the problem. Before our obligation to fix the problem begins, all of the following conditions must be met.

This guarantee only applies to contractors found through using our service. We only guarantee the work performed by our contractors, not the product installed. If there is a defect with any product installed (pipes, sinks, ext.) that is not related to the method of its installation you should work with the contractor to contact the manufacturer to make a claim.

You must be registered with Best Contractors in DFW before entering into an agreement with the contractor. The project must be a residential contract directly entered into with the homeowner.

Best Contractors in DFW does not guarantee commercial or industrial projects or guarantee any projects managed by someone who is not the owner of the home. All claims against a contractor must be based on the written contract between the homeowner and contractor. We will not guarantee the terms of an oral contract or oral change orders.

The guarantee is only applied toward a Best Contractors in DFW contractor and does not cover any contractor not directly found through the Best Contractors in DFW website. This includes other contractors or sub-contractors referred to the homeowner by a Best Contractors in DFW contractor. Sub-contractors working directly for a Best Contractors in DFW contractor is covered by the guarantee. However, if you hire the sub-contractor separately from the Best Contractors in DFW contractor, their work is not covered by the guarantee.

You, the homeowner, must provide Best Contractors in DFW with all documentation related to the agreement with the contractor, including but not limited to the contract, any written guarantees, bids, work orders, canceled checks, money orders, scope of work, and any other relevant documentation. You must also allow Best Contractors in DFW, our agents, and any contractors employed by Best Contractors in DFW access to your property to inspect the work and perform repairs.

Before attempting to collect on this guarantee, the homeowner must exhaust every reasonable effort to resolve the dispute with the contractor. This guarantee comes into effect only if the dispute cannot be resolved directly with the contractor.
You must keep all emails, letters, text, and other communications evidencing your attempts to resolve this dispute.

The homeowner must fill out our complaint form within 60 days of the completion of work. If, at the sixty day mark, the homeowner is still working with the original contractor on repairs found after completion, the homeowner should fill out a complaint form to maintain its rights under this guarantee. The complaint form is available through our website. Fill out the Contractor Rating Form located on the contractor's individual page on Best Contractors in DFW website.

This guarantee only extends to the labor and non-defective parts installed in association with work performed by the contractor. Again, parts that are found defective should be handled through the contractor and manufacturer. It does not cover acts of God, accidents, or any work that has been tampered with. We do not cover normal wear and tear or damage caused by misuse of the installed items. This guarantee is only for work outlined in the original contract. If, after the work is performed, it turns out that the underlying cause of the problem was greater than initially contracted, Best Contractors in DFW does not warrant the fixing of the larger problem. By way of example, if you hire a Best Contractors in DFW contractor to rewire a power outlet and it is later determined that the cause of the problems with the outlet is a bad wiring system in the house, we only guarantee the initial contract for the outlet, not the larger issue determined at a later date. If you wish for this warranty to apply to the larger problem, you must enter into a new contract for the larger project.

WE WILL NOT WRITE YOU A CHECK OR GIVE YOU ANY OTHER FORM OF PAYMENT. We guarantee that, if the work is not done properly in accordance with the written agreement, after all efforts to have the original contractor complete the work, we will hire a contractor within our network and spend up to $10,000 to fix the problem. We have access to a large pool of experienced contractors and the ability to get the job done at a fair price. WE WILL NOT REIMBURSE THE HOMEOWNER ANY MONEY THEY SPEND ON A THIRD PARTY CONTRACTOR. If you have a legitimate complaint about our choice of contractor, we will make every effort to find another, mutually agreeable contractor. However, if you hire another contractor without our express permission we will pay nothing.

If you refuse to allow us to use our own contractors, then Best Contractors in DFW will no longer be responsible for repairing the issue. For the sake of the homeowner and ensuring the best results possible, we will not use a contractor we don't guarantee. WE WILL NOT PAY FOR A THIRD PARTY CONTRACTOR TO DO THE WORK.

4. Procedures for filing a complaint:
 
A complaint must be filed with Best Contractors in DFW within 30 days of the completion of work. If a complaint is not received within 30 days of the completion of work, this guarantee will not apply and you are not entitled to any assistance, payments, or corrective actions by Best Contractors in DFW. If the work has been completed and you are still working with the contractor to resolve the dispute, you must still file a complaint within 30 days of the completion of work. The complaint must be filed using our online contact form available on our website

You must provide us with a copy of all contracts and all communications evidencing the work performed and your efforts to resolve this dispute. After the complaint is received, we will notify you the following business day that your claim has been received. If you have not received a call from a representative of Best Contractors in DFW by the end of the next business day, please call the office at 940-435-2177 or resubmit, referencing your initial complaint date, to insure that your complaint has been received and is being processed. We will make every attempt to call you back immediately to begin complaint resolution.

Once your complaint has been received, we will request any additional documentation or information we may need. You must provide any requested documentation within five business days of the receipt of a request for it. Failure to provide the requested documentation within five business days is grounds for denial of a request for service under this guarantee. If you are unable to provide the requested documentation within five business days, let us know immediately and explain why it cannot be provided.

If your complaint is not about the work performed but is about the actions or attitude of the contractor, we will contact the contractor to inform them of the complaint and the complaint will be placed in our file, possibly leading to the contractor's removal from Best Contractors in DFW. However, conflicting personalities or negative feelings toward the contractor is not grounds for dismissing the opportunity for the contractor to complete the work under their contracted responsibilities or under this guarantee. WE WILL NOT PAY TO HAVE ANOTHER CONTRACTOR COME IN BEFORE FIRST DETERMINING THAT THE ORIGINAL CONTRACTOR REFUSES TO FIX THE ISSUE OR COMPLETE WORK. We will do our best to be involved in the continuance of the project if there are personal conflicts with the contractor. We have a very high success rate in resolving these types of conflicts and getting the job done right.

You agree to allow us, our agents, and any contractor hired by Best Contractors in DFW reasonable access to your property to inspect the alleged defects in workmanship.

If, after our investigation, we determine that the complaint is valid, we will notify the original contractor of the defect and give them 21 days to resolve the issue. If the issue is not resolved within 21 days, we will retain another contractor to repair the defects as quickly as possible. If the work is underway with the original contractor but will take more than 21 days to complete, you agree to allow the original contractor to continue until either the work is complete, or it is evident that the original contractor cannot or will not complete the work. You agree to allow our contractor reasonable access to the property to repair the defects.

Best Contractors in DFW will bring in another contractor to determine the cost of repair and will pay up to $10,000 of the cost to repair the defective work. In the event the cost of the work exceeds $10,000, Best Contractors in DFW will provide a written estimate to the homeowner and an agreement must be reached before work is performed. The homeowner must agree to pay any amounts in excess of $10,000.

If, after our investigation, we determine that the complaint is invalid we will notify you in writing of our determination and the reason for it within five business days of our determination. If you disagree with our determination you must notify us in writing within five business days of your disagreement and the reasons for it. Best Contractors in DFW may or may not, at its discretion, act on your notification of disagreement.

If, after our investigation, it is found that the claim by homeowner was fabricated, frivolous, or that the homeowner has tampered with the project, then the homeowner will be held responsible for any cost incurred by Best Contractors in DFW, including but not limited to the cost of any inspection or work performed.

If the work performed by our contractor is altered or a repair attempt was made on the part of the homeowner or any other person not associated with our contractor or Best Contractors in DFW, then our contractor and Best Contractors in DFW will be released of any further responsibility and it will be determined at that time how much the homeowner owes the contractor for work completed. If a refund to the homeowner is determined, Best Contractors in DFW will mediate between the homeowner and contractor to reach an agreement.

5. Additional Terms.

These terms constitute the entire agreement between you and Best Contractors in DFW. It supersedes any prior or contemporaneous negations, discussions, or agreements, whether written or oral, between you and Best Contractors in DFW regarding the subject matter contained in these terms. You represent and warrant that any agreements entered into with third parties, including Best Contractors in DFW contractors, do not interfere with your obligations under these Terms of Guarantee.

With the exception of the guarantee above described, NEITHER Best Contractors in DFW NOR ITS AFFILIATES, EMPLOYEES, AGENTS OR THIRD PARTY CONTENT PROVIDERS SHALL BE LIABLE FOR ANY LOSS RESULTING FROM USE OF THESE SERVICES OR UNAVAILABILITY OF INFORMATION OR CONTENT ON OR IN CONNECTION WITH THE SITE AND SERVICES. THIS INCLUDES BUT IS NOT LIMITED TO ANY LOST PROFITS, LOSS OR DAMAGE TO DATA, OR ANY DIRECT, INDIRECT, OR INCIDENTAL DAMAGES, EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS DISCLAIMER IS APPLICABLE TO ANY DAMAGES OR INJURY RESULTING FROM INADVERTANT OMISSION OF INFORMATION FROM Best Contractors in DFW. WE ARE NOT LIABLE FOR CRIMINAL OR NEGLIGENT ACTIONS OR OMISSIONS BY A THIRD PARTY, INCLUDING CONTRACTORS LISTED ON Best Contractors in DFW.

ANY WARRANTEES BEYOND THE GUARANTEE ABOVE DESCRIBED ARE EXPRESSLY DISCLAIMED. IF A COURT DETERMINES THAT ANY WARRANTY OR DAMAGES CANNOT BE DISCLAIMED OR LIMITED, THEN Best Contractors in DFW LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.

Governing Law. These terms of guarantee and the relationship between you and Best Contractors in DFW will be governed by the laws of the State of Texas and any lawsuit regarding these terms, the guarantee, or the relationship between Best Contractors in DFW and you must be filed in the State of Texas, County of Tarrant. You agree and consent to the exclusive jurisdiction of the state or federal courts located in Tarrant County, Texas and waive any defense of lack of personal jurisdiction or improper venue or forum non conveniens to a claim brought in such court. You agree that any claim or cause of action arising out of or relating to these terms, this guarantee, or the relationship between Best Contractors in DFW and you will be brought within one (1) year after such claim, cause, or action was established. If the time exceeds one year, the claim will be considered closed and no further action can be taken.

Parties to this contract agree that any and all disputes, claims, or controversies arising out of or relating to this agreement shall be submitted to mediation. If the matter is not resolved in mediation, then it shall be submitted to final binding arbitration. The arbitrator will be chosen by Best Contractors in DFW at its sole discretion.

Each of the parties hereto irrevocably waives any and all right to trial by jury in any legal proceeding arising out of or relating to this agreement or the transactions contemplated hereby.

You irrevocably waive any right to participate as a member of a class in any class action matter brought against Best Contractors in DFW.

The Terms of the Guarantee and the Procedures for Filing a Complaint shall be considered conditions precedent for filing any mediation, arbitration, or legal action arising out of or relating to this agreement or the transactions contemplated hereby.

If any provision of this agreement is found to be invalid, the remaining provisions will continue to be effective.
